The Watt Dawg Service provided on this web site allows Users to subscribe/enroll for electrical service provided by independent third party providers. The Watt Dawg website is owned and operated by Watt Dawg an assumed name of World Efficient Energy, Inc. (referred to herein as “Watt Dawg”, “we” or “us”). The use by any User of the Watt Dawg Service offered on this website is conditioned on the complete acceptance of the terms and conditions of use set forth in this Terms of Use Agreement and is legally binding. Any User who utilizes the services provided on this website agrees to all of the terms and conditions set forth herein. Any User must be eighteen years of age or older.
Watt Dawg is not an electrical service provider. The Watt Dawg Service efficiently aids Users in the selection of a third party electricity provider suggested by Watt Dawg based on Watt Dawg’s analyses of the offers from third party energy providers when applied to the individual needs and uses of each User. Watt Dawg may also aid in the selection of other related services. The terms, conditions, fees and prices are wholly and completely subject to a separate agreement between the User and the third party electrical provider. Watt Dawg does not warrant the providing of electrical service by the third party electricity provider. Any contract that a User enters into with a third party electrical service provider will be between the User and the selected third party electrical provider only. Watt Dawg will not be a party to such resultant contract. The duties and obligations under any contract entered into by the User as a result of utilizing the Watt Dawg Service will be solely between the User and the selected third party electrical provider and any disputes that may from time to time arise related to such contract shall likewise be solely between the User and the third party electrical provider.
Any User that violates or breaches this Terms of Use Agreement is subject to having such User’s privileges to utilize the Watt Dawg Service canceled or suspended without notice and without a refund at the sole discretion of Watt Dawg.
Watt Dawg is the provider of the Service and is not a party to any contract concluded pursuant to Each energy transaction shall be consummated directly between the member and third party provider, and Watt Dawg has no interest, as broker or otherwise, in such transaction.
Due to events outside of Watt Dawg’s reasonable control, as well as for software updates, information updates and web site maintenance, periods of downtime may occur.
FEES
In order to utilize the Watt Dawg Service, you must subscribe to the Watt Dawg Service through a subscription, chosen by you, as either an automatically renewing monthly subscription or an automatically renewing annual subscription. You must enter into a separate subscription for each and every electrical meter.
Automatically renewing monthly or annual subscriptions will renew at the end of the subscpiption time period without any additional steps or authorization from the User unless and until the User cancels the subscription by notifying Watt Dawg at customerservice@wattdawg.com.
A User may not transfer a monthly subscription to another meter or User.
TERMS OF PAYMENT
Watt Dawg will charge Users credit card on each billing date for the chosen Watt Dawg Service subscription. The User is solely responsible for reviewing the User’s credit card statement for billing accuracy.
User’s subscription will automatically renew at the end of each subscription time period at the same rate or fee as the initial subscription time period and User, by authorize the automatic charge of the subscription fee to the credit card provided by User on each unless and until such time as User cancels the subscription by contacting Watt Dawg at customerservice@wattdawg.com. Such Cancelation will not take place until the end of the next subscription time period unless the User notifies Watt Dawg of User’s termination of the applicable subscription at least thirty (30) days prior to the renewal. Any and all fees paid prior to cancellation are nonrefundable.
When a User provides the User’s credit card information to Watt Dawg, the User represents that the User is an authorized user of the card, and agrees to notify Watt Dawg of any changes to the credit card including a change in the account number, expiration date, and billing address, or if the expiration or cancelation of the card. Further, the User agrees that Watt Dawg may receive updated credit card information directly from the credit card issuer. Further, the User, by providing the User’s credit card information to Watt Dawg, authorizes Watt Dawg to charge the applicable subscription fees (and any other applicable fees, such as an early termination fee) to User’s credit card on file.
If a User’s credit card expires without being updated with Watt Dawg (whether by the User or directly from the credit card issuer), the User authorizes Watt Dawg to continue billing the User’s credit card and the User will be responsible for any uncollected amounts.
Watt Dawg will charge the User’s credit card in advance, such that the User’s credit card will be billed prior to the start of each subscription time period.
All charges in are in U.S. Dollars.
Watt Dawg may increase the subscription fee from time to time; however, Watt Dawg will not charge the User an increased subscription fee without first giving the User a thirty (30) day prior notice of the increase in the fee. Unless and until a User terminates use of the Watt Dawg Service by notifying Watt Dawg of such termination, the User continues to accept and authorize the charge of the subscription fee.
If any charge remains open and unpaid, Watt Dawg reserves the right to suspend or terminate the subscription to the service without notice. User agrees to pay to Watt Dawg any outstanding balance in full within thirty days of cancelation of User’s subscription plus a late charge on all amounts that are more than thirty days past due at the rate of 1.5% of the past due amount or the highest rate allowed by law (whichever is less) per month. These terms are in addition to and not in lieu of any other legal right or remedies of Watt Dawg with regard to collection of any outstanding subscription fees.
Watt Dawg reserves the right to refer any unpaid account to a third party collection agent for collection. User will remain liable to Watt Dawg for all unpaid charges and any and all fees and/or costs incur to collect those charges (including, but not limited to, collection agency fees).
WATT DAWG SERVICES
The relationship between Watt Dawn and User is solely one of the providing of a service by Watt Dawg and the acceptance of such service by User. This is a contractual relationship; however, User acknowledges that no joint venture, partnership, employment or agency relationship exists between the parties as a result Users utilization of the Watt Dawg Service. If any term or provision hereof is declared by a court of competent jurisdiction to be illegal or invalid, such illegal or invalid term or provision shall not affect the balance of the terms and provisions hereof. This agreement contains the entire agreement between the parties pertaining to the subject matter hereof with respect to User’s use of this site. Any rights not expressly granted herein are reserved.
Use of Watt Dawg Service
By using this website and subscribing for service, the User represents to Watt Dawg and the third party electricity provider that User is eighteen years of age or older and possesses the legal authority and ability to enter into the subscription with Watt Dawg and the contract with the third party electricity provider in accordance with all terms and conditions herein set forth on this website and/or set forth by the third party electricity provider. User agrees to be financially responsible for any and all charges to User as a result of User’s utilization of the Watt Dawg Service and/or charges to User from a selected third party electricity provider. You agree that you will be completely responsible for all charges, fees, duties, taxes and assessments arising out of the purchases and orders you make through this site.

ANY INACCURACIES, OMISSIONS AND/OR OTHER PROBLEMS (INCLUDING ANY DELAY IN THE UPDATE OF INFORMATION FROM THIRD PARTY ELECTRICITY PROVIDER RATES AND/OR PROGRAMS) WITH THE INFORMATION ON WATT DAWG’S WEBSITER OR IN THE WATT DAWG SERVICE ARE ACCEPTED BY USER AT USER’S SOLE RISK. Although we strive to make the Watt Dawg service available as much as possible, there may be periods of downtime (for example, for scheduled maintenance, software updates, or events outside of our reasonable control).
Third Party Electricity Service Providers
Watt Dawg makes no representation or warranty the information on the Watt Dawg web site is complete, accurate or comprehensive. The information may not be up to date. The information may not contain all options from all third party electricity providers. The information may include third party electricity providers that do not service the User’s address. Further, Watt Dawg may, at its sole discretion, decide not to include the services provided by a particular third party electricity provider for any reason or no reason at all. As a result, there may be third party electricity providers that do not appear on the Watt Dawg web.
User explicitly authorizes Watt Dawg to request and/or retrieve account information related to User’s prior electricity usage. Watt Dawg may set up accounts, on behalf of User, in order to retrieve this information when necessary. Such accounts may be established with User’s Transmission and Distribution Service Provider (“TDSP”) or with Smart Meter Texas (“SMT”). If established, User’s credentials will be made available to User at User’s request. User agrees to abide by the SMT Terms and Conditions whenever an account is established on User’s behalf.
User agrees and understands that User is appointing Watt Dawg as User’s agent for purposes of selecting and enrolling the User’s service location for electricity service with Retail Electricity providers from time to time on behalf of User. USER AGREES AND ACKNOWLEDGES THAT USER AUTHORIZES WATT DAWG TO ENROLL THE USER’S SERVICE LOCATION DIRECTLY WITH RETAIL ELECTRICITY PROVIDERS ON BEHALF OF USER. Additionally, User agrees and acknowledges that Watt Dawg may call a third party electricity provider on User’s behalf, in reference to User’s account.

User may revoke this authorization at any time by notifying Watt Dawg at customerservice@wattdawg.com. User agrees and acknowledges that Watt Dawg’s ability to support the User may be limited or compromised without these authorizations.
No Unlawful or Prohibited Use
User warrants that User will not use the Watt Dawg Service or the Watt Dawg web site for any purpose that is unlawful or prohibited by the terms, conditions and notices of this Terms of Use Agreement.
Change of Terms and Conditions
Watt Dawg reserves the right to change the Terms of Use Agreement at any time.
